Welcome to Cheers! These Terms of Use ("Terms") govern your use of the Cheers mobile application ("App"). By using the App, you agree to these Terms. If you do not agree, please do not use the App.
1. Acceptance of Terms
By downloading, installing, or using Cheers, you agree to be bound by these Terms and our Privacy Policy. We may update these Terms from time to time, and your continued use of the App constitutes acceptance of any changes.
2. Eligibility
You must be at least 13 years old to use Cheers. By using the App, you represent that you meet this age requirement.
3. Account and Display Name
When you use Cheers, you create an anonymous account with a display name of your choice. You are responsible for:
- Choosing an appropriate display name that does not impersonate others or contain offensive content
- Maintaining the security of your device and account
- All activity that occurs under your account
4. Acceptable Use
You agree to use Cheers only for lawful purposes and in accordance with these Terms. You agree NOT to:
- Use the App to harass, abuse, or harm others
- Send unwanted or spam cheers to users
- Impersonate any person or entity
- Use offensive, vulgar, or inappropriate display names
- Attempt to gain unauthorized access to any part of the App
- Use the App for any illegal purpose
- Interfere with or disrupt the App or servers
5. User Content
The App allows you to set a display name. You retain ownership of your content but grant us a license to use, display, and distribute your display name within the App for the purpose of providing the service.
6. Friendships and Bands
Cheers allows you to connect with other users through friendships and bands. By accepting a friendship or joining a band, you consent to:
- Receiving cheers from connected users
- Your display name and activity being visible to connected users
- Appearing on leaderboards visible to your friends
7. Push Notifications
By enabling push notifications, you agree to receive notifications when friends send you cheers. You can disable notifications at any time through your device settings.
8. Intellectual Property
The Cheers App, including its design, features, and content, is owned by us and protected by intellectual property laws. You may not copy, modify, distribute, or reverse engineer any part of the App.
9. Disclaimer of Warranties
The App is provided "as is" and "as available" without warranties of any kind, either express or implied. We do not guarantee that the App will be uninterrupted, error-free, or secure.
10. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the App.
11. Termination
We reserve the right to suspend or terminate your access to the App at any time, without notice, for conduct that we believe violates these Terms or is harmful to other users or the App.
You may delete your account at any time through the App's profile settings.
12. Changes to the App
We reserve the right to modify, suspend, or discontinue the App or any part of it at any time without notice.
13. Governing Law
These Terms shall be governed by and construed in accordance with the laws of the United States, without regard to conflict of law principles.
